Husband has no right in wife’s property. The Supreme Court of India gave such a verdict in a case related to the property of the wife.

A court ordered a man to pay Tk 25 lakh for his wife’s lost jewellery. In that case, the wife had alleged that she had gifted valuable gold articles from her house on the wedding. Besides, the husband was given a check of Tk 2 lakh from his in-laws.

But on the night of the wedding, the husband took all the jewelry of the wife under his control. Not only that, the son-in-law also took the jewelry of the mother-in-law. The son-in-law said that he did this to pay off some debts of his mother.

The woman sued to recover the lost property from her husband. In that case, the High Court ruled that the husband has no right to the wife’s property.

A bench of Justices Sanjeev Khanna and Dipankar Dutt clarified that the wife’s property is not joint property. Husband has no right in wife’s property.

Court said, ‘Husband has no right over wife’s property. If there is a financial crisis in married life, money can be borrowed from the wife, but it has to be paid.
